We kindly inform you that the English translation of our general terms & conditions is a courtesy of Mika Productions and does not in the least represent a legal obligation. Only the German version of these terms and conditions (AGB) is legally binding. Please refrain from using our service if you not understand or accept this statement. Thank you very much.

General Terms & Conditions

§1) Specification of Services

The following terms of use regulate the legal relationship between Mika Productions GmbH and the users of this internet service.

The services provided by Mika Productions thereby merely include the deployment of the website. Mika Productions does not assume any contractual obligation regarding the offered goods on websites which are linked on our website. Rights and obligations from contracts concluded via these websites concerning the purchase of goods are only to be enforced upon the vendor. The vendor is, in particular, also responsible for the compliance with all information, obligations and duties to provide clarifications that are incumbent upon him regarding the sold goods. Further incumbent upon the vendor is the instruction concerning a potentially existing right of revocation.

§2) Privacy

If personal data are collected, it is only done to reply to queries put in by users of this website. Mika Productions may collect, process and use your personal Data only if you consent hereof or if a legal regulation allows the collection, processing and use of your data. §3) Intellectual Property

Unless noted otherwise, all contents and applications on this website, especially patents, utility models, design patents (and recipes) as well as copy- and trademark rights, belong to the intellectual property of Mika Productions. Violation of these rules will exclude you from being allowed to use our goods and services. Further enforcement of claims for prohibitory injunction and damages shall explicitly remain reserved.

§4) Liability

With regard to the provision of services, we are fully liable only for intent, gross negligence and personal damage, whereas we are liable for slight negligence only in the event of breaches of essential contractual obligations as well as in the events of impossibility of performance and default which are on our responsibility.

Our liability is to be limited to the damages typical for the contract, which we had to foresee on the day of the conclusion of the contract based on the circumstances known to us at that time. However, this merely applies to non-fulfilment or breach of obligations from this User Agreement. We are not liable for potential damages concerning the contract closed with the vendor about the acquisition of goods.

Moreover, we are fully liable for damages for which a liability is stipulated by mandatory legal regulations, e.g. the product liability law.

The limitations of liability apply analogously to our agents, too.

§5) Miscellaneous

German is the sole language of the contract.

Provided that the user is a merchant within the meaning of the German Commercial Code, exclusive place of jurisdiction is the registered seat of Mika Productions in Berlin. The same applies if the user’s area of general jurisdiction is not in Germany. Otherwise, the legal place of jurisdiction applies.

Should individual regulations of the present Terms & Conditions be completely or partly void, the validity of all the remaining Terms & Conditions will not be concerned thereby.
